From the Advocate - A gay Colorado man's fight for his late partner's estate may continue, the Colorado Court of Appeals ruled Thursday. Randall Rex has argued that a typed letter in a birthday card given to him by his late partner qualifies as a will. The court ruling revives Rex's claim to the estate of Ronald Wiltfong, who gave Rex the card in 2003 with a letter that said Rex should inherit his property if anything happened to him. The case has been seized by advocates of a referendum on Colorado's Nov. 7 ballot that would make surviving domestic partners the presumed heirs of property, just as surviving spouses now are.

From the Advocate - In papers filed Tuesday, Lambda Legal urged the 10th Circuit of the U.S. Court of Appeals to affirm a lower-court ruling that Oklahoma's anti-gay Adoption Invalidation Law is unconstitutional. The law, quickly passed at the end of that state's 2004 legislative session, says that Oklahoma "shall not recognize an adoption by more than one individual of the same sex from any other state or foreign jurisdiction." "It's dangerous and appalling that state officials seek to jeopardize the safety and well-being of children in Oklahoma," Ken Upton, Lambda Legal's lead attorney in the case, said in a written statement.
